Terms & Conditions
Effective Date: 1st March 2026
VISITORS TO THIS WEBSITE ARE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (“AGREEMENT”). PLEASE READ THESE CAREFULLY BEFORE CONTINUING TO USE THIS SITE. YOUR USE OF THIS WEBSITE CONSTITUTES YOUR UNCONDITIONAL ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, PLEASE DO NOT USE THIS SITE.
1. Corporate Governance & Interpretations
The Shibu companies have their own separate legal identities, but in this Agreement, “Shibu Group”, “we”, or “us” may be used to refer to Shibu companies in general. To guarantee our strict manufacturing standards, the Shibu Group operates exclusively through our wholly-owned and legally recognized entities: Shibu Metals Private Limited, Shibu Aluminium Industries, Shibu Enterprises, Shibu Metcast, Gratis Energies, Infiniti Woodkrafts, Shibu Plantations, Wellmate Aluminium Private Limited, UtensilKart By Shibu, and Bartan Bazaar By Shibu. We do not operate through any other subsidiaries, partners, or splinter companies. Any entity claiming affiliation outside of this authorized roster is strictly unauthorized. The Shibu Group expressly disclaims any liability, obligation, or legal binding arising from transactions conducted with unauthorized third parties.
2. Disclaimer of Warranties & Information Accuracy
Although the Shibu Group attempts to ensure all information, CAD representations, and recommendations (hereinafter “Information”) provided on this website are correct, we make no representations or warranties as to the completeness or accuracy of the Information. Information is supplied upon the condition that the persons receiving the same will make their own determination as to its suitability for their purposes prior to use or in connection with making any corporate purchasing decision.
THIS WEBSITE AND ALL CONTENT HEREIN ARE PROVIDED TO YOU ON AN “AS IS” AND “WHERE-IS” BASIS, WITHOUT ANY WARRANTY. THE SHIBU GROUP MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, WITH RESPECT TO THE WEBSITE, THE INFORMATION, OR ANY PRODUCTS OR SERVICES TO WHICH THE INFORMATION REFERS.
3. Commercial Quotations (RFQs) & Market Volatility
This website utilizes a B2B Request for Quote (RFQ) mechanism. The submission of an RFQ or an inquiry through this site constitutes an “invitation to treat” and does not constitute a legally binding contract of sale.
Commodity Fluctuations: Due to the inherent volatility of global metal markets (including Aluminum, Copper, Brass, and Stainless Steel), all pricing indicated in digital correspondence is strictly provisional.
Binding Contracts: A legally binding manufacturing agreement is only established upon the mutual execution of a formal Purchase Order (PO) and the successful realization of the agreed-upon advance payment or Letter of Credit (LC).
4. Manufacturing Tolerances & Tooling
Since 1942, we have adhered to uncompromising engineering precision. However, the purchaser acknowledges that in heavy metal manufacturing, casting, and forging, standard industry tolerances regarding exact weight, gauge thickness, and dimensions apply. Unless explicitly stated in a signed contract, all custom molds, dies, and tooling engineered by the Shibu Group remain the exclusive property of the Shibu Group, regardless of whether a tooling or development fee was assessed.
5. Global Export Logistics, Availability & Risk of Loss
As a recognized multi-Star Export House, our global shipping is governed by standard international Incoterms as explicitly specified in your final commercial contract. Unless otherwise stated in the executed contract, the risk of loss, damage, or delay transfers to the buyer upon the handover of goods to the primary carrier or upon the goods departing our Yamunanagar manufacturing facilities. Furthermore, information published on this website may contain references to products or services that are not announced or available in your country due to regional laws or shipping considerations.
6. Intellectual Property, Copyrights, & Trademarks
All content of this website—including text, photographs, graphics, historical archives, and software—is the exclusive property of Shibu Metals Private Limited and is protected by domestic and international copyright laws. Proprietary manufacturing techniques and unpatented operational standards remain our exclusive trade secrets.
AI-Generated Visualizations: To effectively communicate our multi-generational legacy and conceptual engineering capabilities, certain historical visualizations, images, or digital assets on this platform may be generated, enhanced, or optimized utilizing Artificial Intelligence (AI). Such content is utilized strictly for illustrative purposes. While no claim of exclusive human authorship is made over purely AI-generated base elements, the proprietary compilation, design, and surrounding corporate IP of this website remain fully protected.
Permitted Use: You may use and display the materials on your personal computer and print copies solely for internal corporate review and purchasing evaluations.
Prohibited Use: You may not copy, distribute, decrypt, disassemble, modify, or reproduce any part of the website for commercial gain. Unauthorized scraping or reverse-engineering of this site’s contents will be met with immediate legal action.
7. Third-Party Submissions & Indemnification
By submitting inquiries, blueprints, or CAD files via our RFQ system, the User represents and warrants that such content is their own work and its use by the Shibu Group in evaluating a quotation in no way violates the intellectual property rights of any third parties.
The User agrees to indemnify, defend, and hold harmless the Shibu Group, its directors, employees, and affiliates against any liability, loss, or civil claim resulting from the user’s violation of these Terms, including but not limited to the submission of infringing intellectual property.
8. Limitation of Liability
To the fullest extent permitted by law, the Shibu Group, its subsidiaries, affiliates, and employees shall in no way be liable for any damages—whether direct, indirect, consequential, incidental, special, punitive, or exemplary (including, but not limited to, breach of contract, loss of profit, business interruption, or loss of business data)—arising out of the use or inability to use this website, the delayed fulfillment of RFQs, reliance on the content contained herein, or any unauthorized access to our servers by third parties. This limitation of liability shall apply even if the Shibu Group has been advised of the possibility of such damages.
9. Rights to Control Site, Severability, & Termination
Control: The Shibu Group reserves the right to modify, restrict, or terminate the content of this website, or suspend its operation for maintenance, at any time without prior notice.
Severability: If any term of this Agreement is deemed by a Court to be void or unenforceable, such term shall be deemed severable, and the remainder of the Agreement shall remain in full force and effect.
Termination: The Shibu Group reserves the right to terminate your access to this website at any time and without notice if you breach any of these Terms.
10. Governing Law & Exclusive Jurisdiction
These terms and conditions are governed by and to be interpreted strictly in accordance with the laws of India, without regard to the choice or conflicts of law provisions of any jurisdiction. You agree, in the event of any dispute arising in relation to these terms and conditions, your use of the website, or subsequent B2B transactions, to submit to the exclusive jurisdiction of the competent courts located in Yamunanagar, Haryana, India for the resolution of all such disputes.
